Stats. § 60.11(2)(c) to exercise village powers and the town has a population of less than 2,500, according to the most recent regular or special federal census, Wis. Stats. § 990.01(29). The town board hereby exercises village powers under Wis. Stats. § 60.22(3) and establishes a five-member plan commission under Wis. Stats. § 60.62(4), Wis. Stats. § 61.35, and Wis. Stats. § 62.23. The plan commission shall be considered the town planning agency under Wis. Stats. § 236.02(13) and Wis. Stats. § 236.45, which authorize, but do not require, town adoption of a subdivision or other land division ordinance. Sec. 16-1. - Penalties · p. 1 · Open source(a)No person shall intentionally cause damage to any physical property of the town without its consent.(b)Except as otherwise herein provided, any person who violates this article shall upon conviction pay a forfeiture of not less than $50.00 and not more than $250.00, together with the costs of prosecution and penalty surcharge.(c)If any person who is convicted of a violation of this article was also convicted of a violation of this article within three years preceding the violation for which he is about to be penalized, such person shall pay a forfeiture of not less than $100.00 and not more than $500.00, together with the costs of prosecution and penalty surcharge. In this subsection, the dates of violation shall be used to determine whether or not a person has been convicted within three years preceding the violation for which he is about to be penalized.(d)In default of the payment of any of the penalties in this section by any person who has the ability to pay such forfeiture and costs and penalty surcharge, such person shall be confined in the common jail of the county until such forfeiture, costs and penalties are paid, but in no event shall such confinement exceed 30 days.
