City of Middleton - CHAPTER 11 - BUILDING CODE

(1)Short TitleThis Chapter shall be known as the Building Code of the City of Middleton. It may be cited as such and will be referred to as "This Code."(2)Purpose of CodeThe purpose of this Code is to provide certain minimum standards, provisions and requirements for safe and stable design, methods of construction and uses of materials in buildings and structures hereafter erected, constructed, reconstructed, altered, enlarged, repaired, moved, converted to other uses or demolished and to regulate the equipment, maintenance, use and occupancy of all buildings and structures.(3)State CodesThe following provisions of the State of Wisconsin Administrative Code, including all subsequent amendments and recodifications thereto, are hereby adopted by reference and incorporated in this code as if fully set forth, exclusive of any penalties or enforcement and abatement procedures. Violations of the provisions hereby adopted shall be subject to penalties, enforcement and abatement procedures as set forth in Section 11.20 of this code. (1)Permit RequiredNo plumbing or drain laying shall be done in the City except in the case of repairing leaks or stoppages, without a permit being first issued therefor by the Plumbing Inspector and payment of the proper fee as hereinafter required.(2)ApplicationThe applicant for a plumbing or drain laying permit shall file with the Plumbing Inspector a plan and application showing in detail the work to be done. Before the Plumbing Inspector issues a permit he or she shall approve the plan and application filed with him or her.(3)Plumbing Plan ApprovalPlan approval is required for buildings other than one- or two-family dwellings where new installations, additions, and alterations involving twelve (12) or more fixtures. (1)Permit RequiredNo person shall operate a mobile food establishment in the City of Middleton without obtaining a permit under this Section.(2)Definitions(a)"Mobile Food Establishment" means a restaurant or retail food establishment as the term defined in Wis. Stat. § 97.30(1)(c) where food is sold to members of the general public from a movable vehicle, push cart, trailer, or boat which periodically or continuously changes location including movable concession stands and similar temporary stations not operating from a permanent building licensed as a restaurant including those designed to operate as temporary food establishments or traveling retail food establishments as those terms are used in Wis. Admin. Code Chap. § ATCP 75 "Appendix" (the "Wisconsin Food Code").
